These Terms of Service (“Terms”) govern your access to and use of the website kissanbharat.com and all associated content, tools, and features (collectively, the “Platform”), operated by Kissan Bharat (“Kissan Bharat”, “we”, “us”, or “our”). By accessing or using the Platform, creating an account, or submitting any enquiry or form, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please do not use the Platform.

1. Acceptance of Terms

Your use of the Platform in any manner, including browsing, registering for an account, or submitting an enquiry, constitutes your acceptance of these Terms. These Terms apply to all visitors, registered users, and others who access the Platform.

2. Description of Service

Kissan Bharat is an online information and discovery portal for Indian farmers. The Platform provides:

• Listings and information about new and used tractors, farm implements, and harvesting machinery from various brands;
• An indicative EMI / finance calculator;
• Farming guides, crop and livestock information, agricultural news, government scheme resources, and web stories;
• Enquiry and contact forms, including “Get Best Price,” “Book Now,” and similar features, through which you can request more information or pricing about a tractor, implement, or service; and
• Optional account registration (“Login / Sign Up”).

Kissan Bharat acts solely as an information aggregator and facilitator. We are not a tractor or farm equipment dealer, manufacturer, broker, financier, or lender, and we are not a party to any sale, exchange, financing, insurance, or after-sales arrangement you may enter into. Submitting an enquiry or clicking “Book Now” does not create any obligation to buy or sell, and does not constitute a booking, reservation, or binding contract of any kind with Kissan Bharat. Any such transaction, if you choose to pursue it, takes place directly between you and the relevant dealer, manufacturer, or financial institution, on terms agreed between you and that party.

3. Eligibility

You must be at least 18 years of age, or otherwise have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872, to use the Platform or create an account. By using the Platform, you represent that you meet this requirement.

4. Account Registration

• When you register for an account, you agree to provide accurate, current, and complete information and to keep it updated.
• You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
• You agree to notify us promptly at kissanbharatglobal@gmail.com if you become aware of any unauthorised use of your account.
• We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are used in a manner we reasonably believe is fraudulent, abusive, or harmful to the Platform or other users.

5. Acceptable Use

You agree that you will not:

• Use the Platform for any unlawful purpose or in violation of any applicable Indian law or regulation;
• Submit false, misleading, or fraudulent information through any form, including the enquiry or registration forms;
• Use automated means, such as bots, scrapers, or crawlers, to access, copy, or extract content or data from the Platform without our prior written consent;
• Attempt to gain unauthorised access to the Platform, its servers, or any connected systems or networks;
• Upload or transmit viruses, malware, or other harmful code;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Interfere with or disrupt the operation of the Platform or the experience of other users; or
• Use the contact, enquiry, or registration forms to send unsolicited commercial communications to Kissan Bharat or to third parties listed on the Platform.

6. Listings, Pricing, and Content Disclaimers

Tractor, implement, and machinery information, including horsepower, specifications, images, and “CERTIFIED” labelling for used equipment, is provided for general informational purposes, sourced from manufacturers, dealers, or other publicly available information, and may not always be current, complete, or error-free. Actual specifications, condition, and pricing should be confirmed directly with the relevant manufacturer or dealer before making any purchase decision.

The EMI / finance calculator and any figures relating to “financing facilitated” provide indicative estimates only. They do not constitute a loan offer, pre-approval, or guarantee of financing, and actual terms are determined solely by the lending institution you approach.

Farming guides, crop and livestock information, and government scheme details are provided for general informational purposes only and do not constitute professional agricultural, financial, legal, or tax advice. Government scheme eligibility, benefits, and procedures are subject to change; you should always verify current details directly with the relevant government department or official source before relying on them.

Statistics displayed on the Platform, such as the number of farmers connected, dealer locations, or financing facilitated, are aggregate figures provided for general context and may be approximate or rounded.

7. Intellectual Property

All content on the Platform, including text, graphics, logos, the “Kissan Bharat” name and logo, layout, and design (excluding third-party trademarks and content described below), is owned by or licensed to Kissan Bharat and is protected under applicable Indian intellectual property laws. You may view and use the Platform for your personal, non-commercial use, but you may not copy, reproduce, modify, distribute, or create derivative works from our content without our prior written permission.

Brand names, logos, and trademarks of tractor and implement manufacturers, such as Mahindra, Escorts, Farmtrac, Powertrac, Swaraj, John Deere, New Holland, Massey Ferguson, Sonalika, Eicher, and Kubota, displayed on the Platform belong to their respective owners and are used for identification and informational purposes only. Their appearance on the Platform does not imply any endorsement, sponsorship, or affiliation between Kissan Bharat and the respective brand owner, unless expressly stated.

8. Third-Party Links and Content

The Platform may contain links or banners directing you to third-party websites, including manufacturer or dealer websites, government websites, and social media platforms. We do not control and are not responsible for the content, accuracy, or practices of any third-party website. Accessing a third-party website is at your own risk and is subject to that website’s own terms and privacy policy.

9. Communications Consent

By submitting an enquiry, registering an account, or contacting us through the Platform, including by call, SMS, email, or WhatsApp, you consent to being contacted by Kissan Bharat through these channels in relation to your enquiry or account, and, where you have given consent, for promotional or informational updates. You may opt out of promotional communications at any time by contacting us at kissanbharatglobal@gmail.com or by following the unsubscribe or opt-out instructions provided in such communications. This does not affect service-related communications necessary to respond to an active enquiry.

10. Disclaimer of Warranties

The Platform and all content, tools, and features are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that any defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Kissan Bharat, its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Platform, including but not limited to:

• Any transaction, dispute, or disagreement between you and a third-party dealer, manufacturer, financier, or other party you engage with after using the Platform;
• Any decision made in reliance on information, pricing, specifications, or government scheme details provided on the Platform; or
• Any unauthorised access to or alteration of your transmissions or data.

Nothing in these Terms shall be construed to limit liability that cannot be excluded or limited under applicable Indian law.

12. Indemnification

You agree to indemnify and hold harmless Kissan Bharat, its officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms, your misuse of the Platform, or your violation of any applicable law or third-party right.

13. Termination

We may suspend or terminate your access to the Platform, including your account, at any time, with or without notice, if we reasonably believe you have violated these Terms or for any other reason at our discretion. You may stop using the Platform or request closure of your account at any time by contacting us.

14. Changes to These Terms

We may revise these Terms from time to time to reflect changes in our services, legal requirements, or business practices. The updated Terms will be posted on this page with a revised “Last Updated” date, and your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

15. Language

These Terms are published in English. While the Platform’s content is available in multiple Indian languages, the English version of these Terms shall prevail in the event of any conflict or discrepancy with a translated version.

16. Grievance Redressal

In accordance with the Information Technology Rules, 2021, complaints or concerns regarding content on the Platform or your use of it may be directed to our Grievance Officer:

We will acknowledge complaints within 24 hours of receipt and endeavour to resolve them within 15 days.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Subject to applicable law, any dispute arising out of or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts at Gurugram, Haryana.

18. Miscellaneous

• Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kissan Bharat regarding your use of the Platform.
• Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
• No Waiver. Our failure to enforce any provision of these Terms shall not be construed as a waiver of that or any other provision.
• Force Majeure. We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, government action, or internet or network failures.
